Handling cases in which a claim of child abuse and neglect is made can be very confusing and stressful. Findings of child abuse and neglect are sometimes based on physical injuries to a child, but they can also be based on severe emotional harm. When a parent is at risk of losing their child, it can be life-changing for them, and attorneys rightfully are concerned with how best to advocate these issues. This CLE is designed to help counsel understand how best to advocate for parents concerned for child abuse and neglect, or accused of child abuse or neglect, and to do so with knowledge, skill and compassion.

Attendees will be provided with the necessary steps to identify when the child may be a victim of maltreatment at the hands of the parents, foster parents, siblings, etc. The role of the court is to protect children from being harmed, but judges must also protect the rights of parents and children to remain together if the child can remain in home safely. Attendees will learn the definition of child abuse and neglect, when and how to urge Division action, when parents do NOT want a Division case filed even when abuse is suspected, strategies for using agency records for discovery in non-Division  cases, the use of law guardians in non-Division cases and so much more! This critical new seminar will provide you with the confidence and essentials you need to know when representing clients who believe their children have been abused or who are accused of child abuse or neglect.

This program has been approved by the BCLE of the Supreme Court of NJ for 2.0 hours of total CLE credit. Of these, 2.0 qualify as hours of credit towards certification in matrimonial law.
