The seminar will focus on the following:

  • Defining "Free Appropriate Public Education” under Federal Law
    • Individuals with Disability Education Act ("IDEA”)
    • Relevant Supreme Court case law
  • Implementation of IDEA in the NJ Administrative Code 6A:14
  • Defining the School District’s obligations to a student, including
    • Defining eligibility and classification requirements;
    • Defining least restrictive environment;
    • Continuum of placements for special education students;
    • Parental protections in special education law;
  • Unilaterally placing a student in an out-of-district school
    • Providing proper legal notice
    • Seeking reimbursement from the School District; and
  • Filing for Due Process should a dispute arise with a School District regarding programming or placement.

This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.5 hours of total CLE credit.

Cost: $5-Law Clerks; $10-Young Lawyers; $15-MCBA Members; and $25-All Others (includes a light breakfast)
