The seminar will focus on:
  • What is mediation and why is it beneficial?
  • Differences and similarities between court-ordered mediation and private mediation.
  • How to become a court-ordered mediator.
  • Review of important Court Rules concerning court-ordered mediation.
  • Difficulties encountered in the court-ordered mediation process.
  • Time for mediation (after issue joined; during discovery; or the end of the     discovery period).
  • The organizational conference call and its written confirmation to avoid misunderstandings.
  • Mediator Preparation - presence at mediation; immediate authority to settle.
  • The mediation session(s):
    • Ground rules, goals to be attained
    • When to speak to each side separately and together, and what to say.
  • Confidentiality.
  • What to do if a settlement is reached.
    • Discussion of the Willingboro case.
  • Mediator’s Compensation.

This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 2.0 hours of total CLE credit.

Cost: $10-Superior Court Law Clerks; $20-MCBA Young Lawyers; $25-MCBA Members; and $40-All Others
