Charles D. Whelan, III, Esq.

Chuck graduated from Rutgers University with high honors in 1978, and completed his JD at Rutgers School of Law in Newark in 1981, where he was honored with the U.S. Law Week Award.  Following law school, Chuck clerked for the late Samuel Allcorn, Presiding Judge of the Appellate Division.  He is admitted to the New Jersey and New York bars and is admitted to practice before the United States District Courts for New Jersey, the Southern District of New York and the Eastern District of New York, as well as the U.S. Courts of Appeals for the Second and Third Circuits, and the United States Supreme Court.  He is a member of and General Council delegate to the New Jersey State Bar Association, as well as being a member and trustee of the Middlesex County Bar Association.
 
Chuck’s practice is focused upon real estate transactions and litigation.  He has closed thousands of titles and mortgage loans.  He also handles commercial transactions as well as the purchase and sale of businesses.  Due to his experience as a transactional attorney and litigator, Chuck has also practiced in the area of title litigation for many years, representing many national title insurers. 

He has also engaged in such diverse real estate-based practice areas as foreclosures, condominium formation, landlord/tenant, bankruptcy, construction and new home development, and land use law and litigation.  He also has a substantial practice in commercial and Chancery litigation, and served as a Superior Court mediator for five years.

In addition, Chuck serves as a panel chair for the District VIII Fee Arbitration Committee and volunteers for Central Jersey Legal Services as well as many other organizations over the years.

For 22 years, he served as pro bono general counsel for Greater Plainfield Habitat for Humanity during which time more than 30 homes were completed for deserving families.

He has been accepted by the New Jersey Superior Court as an expert in the field of real estate law.  He has lectured for NJICLE as well as the MCBA.  He has written several published articles in the area of real estate practice.  Chuck has also served as an expert witness for and against attorneys in cases of legal malpractice arising from real estate transactions, and has represented plaintiffs and defendants in that field.  He has been recognized by Who’s Who in American Law, and has received an AV rating from Martindale Hubbell.   

Chuck presently lives in Warren Township with his wife Danette, and they have two sons, Josh and Jack.  In his spare time, he enjoys hiking and mountain climbing.
